Terms of Service

Draft of 27 October 2026

These Terms are an agreement between Warsita ("Warsita", "we") and the business or person whose workspace we create ("Customer", "you"). By accepting an invitation or using the service you accept these Terms, the Acceptable Use Policy and the Privacy Policy.

1. The service

Warsita connects WhatsApp numbers you control to your software. You link a number as a linked device, the way WhatsApp Web does; Warsita then sends the messages your application asks it to send through a REST API (api.warsita.com), forwards the events it receives to your webhook, and lets you manage everything in a dashboard (app.warsita.com). The service is offered to businesses and professionals, not to consumers for personal use.

2. Access and accounts

  • Warsita is invitation-only. We create your workspace, choose its plan and invite its first owner; owners can invite further members.
  • You must be at least 18 and able to bind the business you use Warsita for.
  • Keep your password, personal access tokens and session API keys secret. You are responsible for everything done with them, including by members you invite. Tell us at hello@warsita.com as soon as you suspect one is compromised; you can revoke tokens and regenerate keys yourself at any time.

3. Plans, payment and suspension

  • Your plan sets how many sessions (WhatsApp numbers) your workspace can link. Messages are not charged individually.
  • Fees, the paid period and how you pay are agreed with you and shown on your invoice. We record payments manually; your workspace stays active until the end of the paid period.
  • We remind workspace owners by email before the paid period ends. If it is not renewed, the workspace gets a grace period of 3 days; after that it is suspended: sessions are paused (they stay linked) and the API stops sending until a payment is recorded.
  • Fees already paid are not refunded, except where the law requires it or we end the agreement for reasons other than your breach. Fees exclude taxes; you pay any taxes that apply to your purchase.

4. WhatsApp

  • Warsita is not affiliated with, endorsed by or sponsored by WhatsApp or Meta. It uses WhatsApp's linked-device protocol, not the official WhatsApp Business Platform.
  • Your use of WhatsApp remains subject to WhatsApp's own terms. WhatsApp may restrict, log out or ban a number at any time, for example for messages that look like spam, and we cannot reverse its decisions. You accept that risk for every number you link.
  • A linked session depends on your phone: WhatsApp ends the link if the phone stays offline for about 14 days or the device is logged out from the phone.
  • WhatsApp may change its protocol without notice. We work to restore service quickly when that happens, but cannot guarantee that a feature keeps working.

5. Your responsibilities

  • Use Warsita only as the Acceptable Use Policy allows. Message only people who expect to hear from you, and stop when they ask.
  • You are responsible for the content you send, for having a lawful basis to message each recipient and to process their data, and for complying with the laws that apply to you, including personal data protection and electronic information laws.
  • Link only numbers you own or are authorised to use.
  • Do not try to break, overload or get around the limits and security of the service, or access workspaces that are not yours.

6. Your data

  • You keep all rights in the messages, contacts and other data you send through Warsita ("Customer Data"). You give us the rights we need to process it to run the service for you.
  • We process Customer Data as described in the Privacy Policy. Message content is kept only when message logging is on for a session, and logs are deleted after 30 days.
  • The keys that keep a WhatsApp number linked are stored in our database so sessions survive restarts. We protect them like credentials; anyone who obtained them could act as that linked device.

7. Availability and changes

We aim to keep Warsita available at all times but do not promise a particular uptime. We may carry out maintenance, which we try to schedule outside busy hours, and we may change or retire features, giving reasonable notice when a change takes away something you rely on.

8. Suspension and termination

  • We may suspend a workspace or session immediately if it breaches the Acceptable Use Policy, puts the service or other customers at risk, or is used unlawfully. We will tell you why unless the law or an investigation prevents it.
  • You can stop using Warsita at any time; ask us to close your workspace and we will delete its Customer Data within 30 days, except copies we must keep by law and backups that expire within 7 days.
  • We may end the agreement with 30 days' notice, or immediately for a serious or repeated breach.

9. Warranties and liability

  • The service is provided "as is". To the extent the law allows, we disclaim all warranties not stated in these Terms, including that it is uninterrupted, error-free or fit for a particular purpose.
  • Neither party is liable for indirect or consequential losses, lost profits or lost data. This does not limit your payment obligations or your responsibility for breaches of the Acceptable Use Policy.
  • Our total liability under these Terms is limited to the fees you paid for the 3 months before the event that gave rise to the claim.
  • You will compensate us for claims by third parties arising from the content you send or your breach of these Terms.

10. Changes to these Terms

We may update these Terms. We will email workspace owners at least 30 days before a material change takes effect; continuing to use the service after that means you accept it.
